Hi Rachel,

All good points, and I would underscore the comment in your last paragraph.

You could probably dedicate an entire post on the prudence one should exercise before, during and after a contract is signed, assuming a contract exists to begin with.

Furthermore, finding out whether the project envisioned requires a building permit is sometimes overlooked. Gas insert fireplaces are a common example.

Hi Rachel, I am living in condo in Toronto and I plan to make some renovations. I have get agreement and permission of the board. However, there are some problems with my neighbours. They are afraid of the noise. Should I accept their complaints if I have permission?

To Toronto Condos:

As long as you have the requisite permission from the Board, your issue with your neighbor, at least for now, is not a legal one. As it seems that you already have a relationship with these people, you may want to make an effort to find out what the real issue is. Do they have a baby? Do they work from home? If you find out that they will be at work all day, perhaps it is best to make sure your contractors are only making noise during regular business hours (while they are out) and assure your neighbor that you are sensitive to their situation. They should not give you too much of a hard time – next year the shoe may be on the other foot.
